TERMS AND CONDITIONS FOR ONLINE SALES General provisions
The following terms and conditions are valid only between the company MICROFFICINA - Florence jewelry, registered office in Via San Zanobi, 94r - 50129 Firenze REA FI-340640, P.IVA 01892090489, hereinafter called ''MICROFFICINA'' and any person who shops online on the website www.microfficina.it hereinafter called ''CUSTOMER''.
These conditions may be modified and their publication date on the website is the date of entry into force. These conditions govern the shopping on www.microfficina.it, according to the rules of Part III, Title III, Chapter I of the Code of Consumption, L.D. n. 206/2005, edited by L.D. n. 21/2014 and by L.D. n. 70/2003.
ARTICLE 1 - Object of the contract With these terms and conditions, MICROFFICINA sells and the CUSTOMER buys remotely movable tangible property shown and offered for sale on www.microfficina.it.
The contract ends exclusively via the Internet, through the access of the CUSTOMER at the web address www.microfficina.it, and the execution of an order of purchase according to the procedure provided by the site itself. The CUSTOMER agrees to take a vision, before proceeding to the confirmation of the order, of these terms and conditions, in particular of pre-contract information provided by MICROFFICINA and to accept them by ticking the box.
ARTICLE 2 - Informations for the customer - art. 49 of L.D. 206/2005 Before ending the contract the CUSTOMER takes a vision of the characteristics of the goods displayed on the product cards in the same moment of the choose of the jewel. Before ending the contract and before validating the order with "payment obligation", the CUSTOMER is informed on: - Total price of the goods (taxes included) and any shipping charges. - Payment methods; - The term within which MICROFFICINA undertakes to deliver the goods; - Terms and conditions concerning the right of withdrawal (art. 7 of this contract); - Information that the CUSTOMER will have to support the costs for the return of the goods in case of withdrawal; - The existence of a legal guarantee of conformity for the goods purchased; - Post-sales support conditions and commercial guarantees provided by MICROFFICINA. ARTICLE 3 - Conclusion and effectiveness of the contract The selling contract is considered completed when MICROFFICINA sends to the CUSTOMER the confirmation of the order e-mail. In the email will be written the details concerning the CUSTOMER and the order number, the price of the goods bought, delivery fees and the shipping address. The CUSTOMER must verify the accuracy of the data written in the e-mail and must quickly communicate (via e-mail or phone) to MICROFFICINA any correction, change or withdrawal of the order, if necessary. MICROFFICINA undertakes to describe and present the jewels sold in the website in the best way possible. Nevertheless, some mistakes, imprecisions or slight differences between the website and the real product could occur. Moreover, the pictures shown on www.microfficina.it don’t stand as a contractual element, since they are only a representation of the jewel. MICROFFICINA undertakes to deliver the goods within 30 days since the confirmation email has sent to the CUSTOMER by MICROFFICINA.
ARTICLE 4 - Availability of the products The availability of the products refers to the real availability at the same moment the CUSTOMER makes the order. Anyway, this availability must be considered merely indicative because, due to the contemporary presence of many customers visiting the website at the same time, the products could be sold to other CUSTOMERS before the confirmation of the order. Even after receiving the confirmation of the order e-mail by MICROFFICINA, some cases of partial or total unavailability of the goods could occur. In these cases the order will be immediately corrected with the elimination of the product unavailable and the CUSTOMER will be quickly informed via e-mail. If the CUSTOMER wants to withdraw the order, MICROFFICINA will reimburse the amount paid within 14 days from the date on which MICROFFICINA was aware of the customer's decision to end the contract.
ARTICLE 5 - Payment methods The CUSTOMER can only pay using the credit cards indicated on the website www.microfficina.it, by bank transfer or by Paypal. In the case of payment by credit card, the actual amount of the order will be charged only when the order is complete and ready for shipment. In the case of payment by Paypal, the actual charge will be when MICROFFICINA sends the confirmation of the order e-mail. The communications concerning payments and data send by the CUSTOMER at the moment of the payment take place on specially protected lines. The security of the payment by credit card is guaranteed by VBV (Verified by VISA) and SCM (Security Code Mastercard) certifications.
ARTICLE 6 - Prices All selling prices of the products shown on the website www.microfficina.it are indicated in Euro (€) and they are already VAT-included. Eventual shipping fees are not included in the buying price, but they will be indicated and calculated at the end of the shopping funnel before proceeding with the payment. The CUSTOMER accepts that MICROFFICINA could modify its prices at any time, anyway your goods will be invoiced on the basis of the prices shown on the site at the same moment of the creation of the order, as it will be displayed in the confirmation email that MICROFFICINA will send to the CUSTOMER. In case of any kind of unexpected error (system error, manual or technical error, etc.) that may occur, the order will be automatically cancelled and the amount spent by the CUSTOMER will be refunded within 14 days since the cancellation date.
ARTICLE 7 - Right of withdrawal In accordance with the legal provisions in force, the CUSTOMER has the right of withdrawal, without any penalty and without giving any specific reason to his choice, within 14 days since the receipts of the products. In case the CUSTOMER makes more purchases in the same order and the delivery of the products takes place on different days, the 14-day period starts from the date of receipt of the last product. The CUSTOMER who wants to express his right of withdrawal should communicate it to MICROFFICINA through an explicit statement, that can be sent by registered mail with return receipt or via certified mail to f.vianello@pec.microfficina.it. The CUSTOMER can exercise his right of withdrawal even by sending any explicit statement declaring the decision to withdraw the contract or alternately The CUSTOMER can fill and send to MICROFFICINA the withdrawal form attached: Withdrawal form (If you will to withdraw the contract please fill and send this following form) MICROFFICINA - Gioielli Firenze Via San Zanobi, 94 rosso FIRENZE +39 055499113 f.vianello@pec.microfficina.it With this form I notify my will to withdraw the selling contract of the following products: - Ordered on: / Received on: - Name of the Customer: - Address of the Customer: - Signature of the Customer: - Date If the CUSTOMER wants to exercise his right to withdrawal he must return the goods within 14 days since the date in which he communicated to MICROFFICINA his will to withdraw the contract according to the article n. 57 of L.D. n. 206/2005. The products must be sent back to MICROFFICINA - Gioielli Firenze Via San Zanobi, 94 rosso FIRENZE or delivered directly at the shop. The CUSTOMER must bear all the costs for returning the goods. The cost is estimated to be more or less 100,00 (one hundred/00) euro. The goods returned must be intact, in its original packaging, complete in all parts and with the fiscal documentation attached. Subject to the right to verify compliance with the above, MICROFFICINA will refund the amount for the products returned within 14 days. According to article no. 56, paragraph 3 of the L.D. n. 206/2005, as amended by L.D. n. 21/2014, MICROFFICINA may suspend the refund until the receipt of the goods or until the CUSTOMER has provided evidence that it has already sent the goods back to MICROFFICINA. MICROFFICINA will make a refund using the same payment method chosen by the CUSTOMER when purchasing. In the case of payment via bank transfer, and in case the CUSTOMER intends to withdraw the contract, it must send to MICROFFICINA, using the form that can be found in our “CONTACTS” page of the website www.microfficina.it, all the bank account details needed to proceed with the refund by MICROFFICINA.
ARTICLE 8 - Delivery methods The goods will be delivered by express courier to the address indicated by the CUSTOMER at the moment of the order not later than 30 days from the date the CUSTOMER receives the confirmation email by MICROFFICINA. Thanks to a tracking code, that MICROFFICINA will send to the CUSTOMER at the moment the shipping is started, it will be possible to the CUSTOMER to check online the development of his delivery. The tracking code indicates information about the courier, the shipping code and all the instructions you need to follow the shipment. The CUSTOMER must check at the same moment it receives the goods that the package is intact and complete, closure tapes too. In the case of tampering and/or breaking the CUSTOMER must immediately contest the shipment and/or the delivery by writing “SUBJECT TO CHECK THESE GOODS BECAUSE ....." (indicate the motivation) on the shipping document released by the courier. Subsequently, the CUSTOMER must report eventual damages within 3 days since the date of receipt of the goods according to the indications provided by the courier that made the shipment. In the case the delivery is returned to MICROFFICINA by the courier due to an error in the address indicated by the CUSTOMER, or due to any other negligence of the CUSTOMER, a new shipment will be possible upon prepayment of the same through a link that will be provided to the customer at the time, or alternatively by wire transfer or paypal.
ARTICLE 9 - Responsibilities MICROFFICINA has no responsibility to eventual disagreements attributable to causes of force majeure, fluke, or bad functioning and disruptions of the Internet, in the event that it fails to execute the order within the terms of the contract.
ARTICLE 10 - Access to the website The CUSTOMER has the right to access the site to consult or to purchase. Any other use, in particular, commercial, of the website and its content is not allowed. The integrity of the site's elements, whether sound or visual, and the related technology remain MICROFFICINA property and are protected by intellectual property rights.
ARTICLE 11 - Cookies The site www.microfficina.it uses ''cookies''. A cookie is a piece of information that is stored on your computer's hard drive by your web browser which tracks your movements within websites. Our site uses cookies to keep track of how often you visit our site, the contents of your shopping cart, previous purchases and to deliver content specific to your interests. Most browsers are automatically set to accept cookies but usually you can alter the settings of your browser to prevent automatic acceptance. ARTICLE 12 - Wholeness These TERMS AND CONDITIONS FOR ONLINE SALES are made up of all the whole clauses that form them. If only one or more of these dispositions is considered not valid or declared such according to the law, regulation or decision of a court having jurisdiction, the other provisions will continue to be fully enforceable and effective.
ARTICLE 13 - Applicable law and jurisdiction These TERMS AND CONDITIONS FOR ONLINE SALES are subjected to the Italian law. Any disputes that cannot be resolved will be subject to exclusive jurisdiction of the Court of the place of residence or domicile of the CUSTOMER if located in the territory of the State. In any case, it is possible to use the mediation procedures provided for in the L.
